This document is an electronic record in terms of Information Technology Act, 2000 & rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage www.way2village.in (“Website”) and the mobile application ‘way2village’ (“App”). Please read the following terms and conditions very carefully as your use of service is subject to your acceptance of and compliance with the following terms and conditions ("Terms"). By subscribing to or using any of our services you agree that you have read, understood and are bound by the Terms, regardless of how you subscribe to or use the services. If you do not want to be bound by the Terms, you must not subscribe to or use our services.

1. INTRODUCTION

Way2village

The portal, www.way2village.in (“Website”) and the mobile application ‘way2village’ (“App”) (collectively “Platform”) is owned, managed and operated by M/s Dime Innovations Private Ltd (Dime), a private Limited company. Way2village enables Online travel and tourism booking and marketing platform for the farm house, resorts and tourism and other packages listed on the Platform from time to time (“Services”).

  • 1. (a). Any person who access and/or use the Platform in any manner (referred as ”you”), shall be subject to these terms and conditions for use and be bound by the policies formulated by Way2village
  • 1. (b). These terms and conditions for use, the policies as list above, and such other policies or terms as may be prescribed by Way2village (“Terms”), together constitute a legally binding agreement between You and Way2village, in connection with the access to or use of the Platform. You are requested to read these Terms carefully before accessing or using the Platform.
  • 1. (c). Way2village may update/modify/amend these Terms (including any portion of it) at any time, with or without advance notice.
  • 1. (d). Using the Services or accessing the Platform constitutes your consent to the Terms. By using the Platform, you signify your acceptance of these Terms and agree to be legally bound by them. If at any time, you do not agree or wish to be bound by these Terms, you may not access use the Platform. These Terms supersede all previous terms and conditions communicated to you by Way2village, for the use of the Platform and all rights and liabilities of Way2village with respect to any Services to be provided will be limited to the scope of these Terms.
  • 1. (e). In addition to these Terms, you may be required to comply with the terms and conditions of the third parties, whose links are contained/embedded in the Services. It is hereby clarified that Way2village shall not be held liable for any transaction between the User and any such third parties.
  • 1. (f) The user shall also be bound to fulfill the eligibility criteria as provided in Indian Contract Act, 1872. The User must be atleast 18 years of age and must possess the legal authority to enter into an agreement so as become a User and use the services of Way2village.
  • 1. (g) In case wherein a User intends to make a booking on behalf of another person, it shall be the responsibility of the User to inform such person about the terms of this Agreement, including all rules and restrictions applicablethereto. In absence of any Service Agreement, user of any of the Way2village platforms and/or Way2village online services whether registered/guest user shall be subjected to the following terms and conditions; For the purposes of this Agreement, any person who does not have a legal or contractual right to access the Services, but does so, will fall within the definition of the user; and will nevertheless be subject to the terms and conditions regulating the usage of Way2village Platforms, inclusive of the terms of our intellectual property rights, confidentiality, etc.

2. CONTENT ON PLATFORM

  • 2. (a). All information, content and material contained on the Platform are and continue to be Way2village’s or relevant third party intellectual property. Further, all trademarks, services marks, trade names and trade secrets in relation to the Platform whether or not displayed on the Platform, are proprietary to Way2village or relevant third party. No information, content or material from the Platform may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without our written permission. Any unauthorized use terminates the permissions granted in these Terms.
  • 2. (b) The contents of Services, information, text, graphics, images, logos, button icons, software code, interface, design and the collection, arrangement and assembly of the content on the Platforms or any of the other Services are the property of Way2village or its affiliates or vendors or partners or relevant third party (“Content”), and are protected under copyright, trademark and other applicable laws. The User shall not modify the Content or reproduce, display, publicly perform, distribute, reverse engineer or otherwise use the Content in any way for any public or commercial purpose or for personal gain.
  • 2. (c) Way2village authorizes you to view and access Content solely for identifying Facilities/services/Products, rendering services and processing 4 | P a g e Cancellation and refunds, in accordance with Return and Refund Policy (ANNEXURE-1) Way2village, therefore, grants to you a limited, revocable license to access and use the Services..
  • 2.(d). You hereby grant to Way2village a royalty-free, perpetual, irrevocable, non-exclusive right and license to adopt, publish, reproduce, disseminate, transmit, distribute, copy, use, create derivative works from, display worldwide, or act on any material, review, feedback, comments etc., posted by you on the Platform without additional approval or consideration in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such content, and the you waive any claim to the contrary over all feedback, comments, ideas or suggestions or any other content provided by them to Way2village through the Platform.

3. DUTIES AND OBLIGATIONS OF USER

  • 3.(a) The User shall be responsible for discharging any obligations as may be implemented by various government for selling travel related products and services; including but not limited to collecting & depositing of tax related monies as notified by respective state or central government authorities from time to time
  • 3.(b) The User shall be bound by terms and conditions and policies of service providers such as airlines, hotels, restaurants /transport vendors, etc. in which booking is made.
  • 3.(c) The user authorizes our website to use/store/otherwise process the personal information relating to the identification of the user which includes but is not restricted to the name and address of the user
  • 3.(d) The Usage/storage/process of the information of the will be done upto the extent necessary for providing services made available on the Way2village Platforms.

4. CONFIDENTIALITY

  • 4.(a) You are solely responsible for maintaining the confidentiality of your Account Information and for restricting access to your computer or mobile or other similar device to prevent unauthorized access to their account. You are requested to safeguard your password and your account and make sure that others do not have access to it. It is your responsibility to keep your Account Information current and accurate. You agree to: (a) immediately notify Way2village of any unauthorized use of the account or any other security breach; and (b) ensure that they exit from their account at the end of each session. Way2village will not be liable for any loss or direct or indirect damage arising from the User’s failure to comply with these conditions. You may be held liable for any losses incurred to Way2village or any other user due to unauthorized use of your account, resulting from the failure to keep your Account Information secure and confidential.
  • 4.(b) You represent and warrant to Way2village that: (a) you are 18 (eighteen) years of age or older; (b) your use of the Platform and/or Services will not violate any applicable law or regulation; and (c) all information that is submitted to Way2village in connection with the Platform and/or Services is true and accurate.

5. BOOKING POLICY AND PAYMENT TERMS

By making a booking, Way2village creates a link between Affiliate/Service Provider (Resorts, farmhouse, Hotels, etc.) and User and provide only technological platform for booking of services and the final liability will be on the respective Affiliate/Service Provider and not on Way2village. User understands that Way2village cannot be held liable in case if the information provided by the Affiliate/Service Provider is found to be inaccurate, inadequate or obsolete or in contravention of any laws, rules, regulations or directions in force.

  • 5.(a) Affiliates/Service providers (such as hotels, Farmhouse, resorts, restaurants /transport vendors etc.) will charge cost of booking. In addition to this Way2village may charge some additional fees which might be the convenience charges or service fees. Way2village may modify these fees time to time as per the discretion. Any such fees will be updated to the user before confirming the booking for the user.
  • 5.(b) In some cases where charges are not properly charged of the booking amount, convenience fee statutory fee or taxes etc. due to any technical error or other reasons Way2village will have a right to charge, claim or deduct amount from the User and User is bound to pay such balance amount to Way2village
  • 5.(c) Any inflation in the price charged by Way2village in relation with change in rates or new imposed tax, levies by the Government shall be borne by the User. This inflation may be without prior notice and could also be retrospective but will always be as per applicable laws
  • 5.(d) In the exceptional cases where user’s booking had not been confirmed for a particular reason, Way2village will initiate the refund of the booking amount paid by the User and intimate the User. Way2village will not provide any compensation or replace the unconfirmed booking. Any refund will be processed as per the defined policies of the service provider and Way2village as the case may be.
  • 5.(e) It is the responsibility of User for all charges, fees, duties, taxes for the using of services as per the applicable laws.
  • 5.(f) The User will make the payment only in the account on the name Way2village. Way2village will never ask for making the payment to any private account or to the account not held on the name of Way2village. If any User make payment to these fraudulent account or on the account which Way2village is not the legitimate holder, then in that case Way2village will not be held liable for the loss. User has no right to recover any amount from Way2village.
  • 5.(g) The User is advised not to share his personal sensitive information like Credit/ Debit card number, CVV, OTP, Expiry date of card User IDs, Password etc. with any person including agents, employees or representative or affiliates of Way2village. Way2village or any agents, employees or representative of Way2village will never ask to share these sensitive information. Way2village will not be liable for any such loss incurred by the User.
  • 5.(h) Payment Confirmation: – As soon as User make the payment, Way2village will send you a confirmation email, along with a unique booking reference number and voucher as a valid proof of payment.
  • 5.(i) If the user booking is confirmed and user do not appear on the date of the booking, Way2village will not refund in that circumstances.

6. CANCELLATION POLICY

  • 6.(a) In event of cancellation by the User, every booking made on Way2village is subject to cancellation charges levied by the Affiliates/service provider, which may vary with respect to Affiliates/ ultimate service providers, accommodation and star rating and Way2village may levy some negligible amount as service fee per booking as cancellation service charges which shall depend on the type of transaction. Some bookings may be non- refundable as per the specific Affiliates/service provider’s policy. Some bookings cannot be cancelled partially as per the specific Affiliates/ ultimate service providers’s policy. Cancellations can be made online or offline through sending an email to mentioned mail of Way2village at the time of booking. Way2village may assist the User in making various amendments for bookings. In few cases, you need to contact the Affiliates/service provider directly.
  • 6.(b)  The User agrees that in the event of non-confirmation of booking due to any technical reasons (like network downtime, disconnection with third party platforms such as payment gateways, banks etc.) or any other similar failures, 8 | P a g e Service Provider’s obligation shall be limited refunding the booking amount, if any, received from the User. Such refund shall completely discharge the Affiliates/Service Provider from all liabilities with respect to that transaction.
  • 6.(c)  Right to cancel By Way2village or Affiliates/Service Providers;- Way2village reserves its right to cancel the booking made with any Affiliates/Service Provider, and forfeit the amount paid by the User, including no liability for any loss or damage caused to the User in the booking cancelled, without any prior notice to the User in the cases including but not limited to:
  • 6.(d)  Any default on part of the User regarding the validity or authorization of the information on the user provided or misrepresentation of facts made;
  • 6.(e)  If any judicial, quasi-judicial, investigation agency, or government authority approaches Way2village/affiliates/Service Provider to cancel the booking;
  • 6.(f)  In event of Force Majeure, the Affiliates/Service Provider shall be unable to honour the confirmed bookings. If Way2village has advance knowledge of any such situations where dishonour of bookings may happen, it will make its best efforts to provide similar alternative to the user or refund the booking amount after deducting applicable service charges, if supported and refunded by that respective Affiliates/Service Provider. The User agrees that Affiliates/Service Provider being merely a facilitator of the services and products booked, cannot be held responsible for any such Force Majeure circumstance.
  • 6.(g)  Way2village at its sole discretion reserves the right to not accept any booking without assigning any reason thereof.
  • 6.(h)  In addition to this Way2village reserve other remedies and recourse under this User Agreement or under applicable law, Way2village may limit the User’s activity, warn other users of the User’s actions, immediately suspend or terminate the User’s registration, or refuse to provide the User with access to the Website if:
  • 6.(i) The User is in breach of this User Agreement; or  Way2village is unable to verify or authenticate any information provided by the User; or  Way2village believes that the User’s actions may infringe on any thirdparty rights or breach any applicable law or otherwise result in any liability for the User, other users of Way2village, or Way2village itself.
  • 6.(j)  If a User breaches this User Agreement, Way2village reserves the sole right to recover any amount due to be paid by the User to Way2village, and to take appropriate legal actions as it deems necessary.
  • 6.(k)  User agrees that that the end service provider may refuse to provide the service(s), agreed to be provided to the User, for any booking made through Way2village with/without assigning any reasons or owing to reasons including but not limited to behavioral issues, public safety, health hazards, infectious diseases, government orders/notification etc. In such scenarios of refusal, the liability that may ensue shall solely vest with the end service provider as it is outside the purview of Way2village and the User agrees that any claim, refund or damages against such refusal shall lie solely against the end service provider and not Way2village.

7. REFUND POLICY

  • 7.(a) Way2village will process the refund only after getting a cancellation request/claim from the customer/user through email or through the defined channel on the website.
  • 7.(b)  Refund against the cancellation of booking will be credited directly in User’s mode of payment after receiving the refund amount from the Affiliates/ultimate service provider. Way2village will process refund within …. hours only after receiving it from the concerned Affiliates/ultimate service 10 | P a g e provider. In some peculiar cases, Processing time for cancellation and refund requests may vary.
  • 7.(c)  Due to Banking Procedures, Refund in credit cards may take duration of 3 days while it may take 7 days in case of net banking transactions.
  • 7.(d) Wallet amount once used for any transaction the remaining amount in the wallet cannot be transferred to your bank account
  • 7.(e) Convenience fees paid at the time of booking is a non-refundable fee and same shall be applicable on all cancellations including any partial cancellation requests.
  • 7.(f) If cancellations made directly with the Affiliates/ultimate service provider (such as Resort, Farmhouse, hotels, restaurants /transport vendors etc.) need to be intimated to Way2village, for the refund process. Processing time for the refund will be subject to the mode of payment. The refund will be initiated in the source account from which payment was made
  • 7.(g) All refunds by Way2village shall be processed as per the Affiliates/ultimate service provider’s rules and cancellation policy. Refunds will be in accordance with the Way2village receiving that refund from the Affiliates/ultimate service provider as may be applicable. The convenience fee made at the time of booking is a non- refundable fee. 

8. DISCLAIMER OF WARRANTIES

  • 8.(a)  way2village will try to make access to and use of the Platform errorfree. However, your access to the Platform may be suspended or restricted to allow for repairs, maintenance, or for introduction of new facilities or services. Please note that Way2village does not take responsibility for any access or use problems that arise from internet related issues at your end. Way2village 11 | P a g e reserves at all times, the right, at its sole discretion, to refuse access to the Platform, terminate accounts, remove or edit content at its discretion.
  • 8.(b) The Platform may contain user generated content which Way2village does not pre-screen and which contains views that may be opinions of users i.e. affiliates/ service providers and also of experts. Way2village does not claim any ownership rights to the text, files, images including photos, videos, sounds, musical works or any user generated content that you may submit or publish on the Platform. After posting any user generated content on the Platform, you continue to own the rights that they may have in that user generated content, subject to the limited license set out herein below. Way2village will do its best to monitor, edit or remove such user generated content where it considers it appropriate or necessary to do so. Way2village does not promise that any user generated content on the Platform is accurate, complete or updated, that it will not offend or upset any person or that it does not infringe the intellectual property rights of third parties
  • 8.(c) As a means to assist you in identifying the facilities/ services of your choice, Way2village provides visual representations on the Platforms including graphics, illustrations, photographs, images, videos, charts, screenshots, info graphics and other visual aids. While reasonable efforts are made to provide accurate visual representations, Way2village disclaims any guarantee or warranty of exactness of such visual representation or description of the facilities/rooms/accommodation premises, with the actual services/facilities ultimately rendered/provided to you. The appearance of the facilities/rooms/accommodation premises when rendered may vary for various reasons. Way2village doesn’t take any ownership, directly or indirectly towards any person whatsoever, with respect to listing/advertisements hosted on Way2village Platforms by Service Providers (if any) and Way2village has not carried out any independent verification on the authenticity or compliance requirements, as may have been required under any law for the time being in force, of such images/ banners/ listings in any format i.e. audio, video, website links, maps, etc. Way2village does not endorse the contents on any such third- 12 | P a g e party websites and/or app and is not responsible for the content of or any damage that may result from your access to or reliance on these third-party websites. If you link to third-party websites and/or app, you do so at your own risk.
  • 8.(d) The Services included on or otherwise made available to you through the Platforms are provided on an “as is” and “as available” basis without any representations or warranties, express or implied, except if otherwise specified in writing. Way2village does not covenant or warrant that:
  • 8.(e) the Services will be made available at all times;
  • 8.(f) the operation of the Platform, including the functions contained in any content, information and materials on the Platform or any third-party sites or services linked to the Platform will be uninterrupted, timely or error-free, that the defects will be rectified, or that the Platform or the servers that make such content, information and materials available are free of viruses or other harmful components

9. INDEMNIFICATION AND LIMITATION OF LIABILITY

  • 9.(a) You agree to indemnify, defend and hold harmless Way2village, its affiliates, service providers, officers, directors, employees, consultants, licensors, agents, and representatives from and against any and all third- party claims, losses, liabilities, damages, and/or costs (including reasonable attorney fees and costs) arising from the your access to or use of the Platform or the Services, violation of these Terms, or infringement of any intellectual property or other rights of Way2village or any third-party. Way2village will notify the you promptly of any such claim, loss, liability, or demand, and in addition to the foregoing, you agree to provide Way2village with reasonable assistance, at their expense, in defending any such claim, loss, liability, damage, or cost.
  • 9.(b) To the fullest extent permitted by law, in no event shall Way2village or any of its directors, officers, employees, agents or content or service providers (collectively, the “Way2village Representatives”) be liable to you for any direct, indirect, special, incidental, consequential, exemplary, special, remote or punitive damage, including, but not limited to damages for loss of profits, goodwill, use, data or other intangible losses arising from, or directly or indirectly related to, the use of, or the inability to use, the Platform or the content, materials and functions related thereto, the Services, provision of information via the Platform, lost business, even if such Way2village Representatives have been advised of the possibility of such damages.
  • 9.(c) In no event shall Way2village Representatives be liable for:
  1. the use or inability to use the Platform and/or the Services;
  2. any content posted, transmitted, exchanged or received by or on behalf of any user, service provider or other person on or through the Platform;
  3. any other matter relating to the Platform or the Services.
  • 9.(d) Way2village is neither liable nor responsible for any actions or inactions of the other users of the Platform including Affiliates/service providers or any breach of conditions, representations or warranties by them. Way2village is not obligated to mediate or resolve any dispute or disagreement amongst two or more users of the Platform.
  • 9.(e) None of the directors, officials or employees of Way2village shall be personally liable for any action in connection with the Platform or the Services.

10. TERM AND TERMINATION

  • 10.(a) These Terms shall be effective from the date of their publication on the Platform.
  • 10.(b)  Way2village reserves the right to suspend or terminate its Services in the event of breach of any terms contained in these Terms, misrepresentation of information, any unlawful activity by you or if Way2village is unable to verify or authenticate any information submitted by you.
  • 10.(c) You may terminate the Agreement at any time by discontinuing the use of the Platforms or Services. By terminating the usage or the Agreement you will be obligated to pay for a facilities/services reserved or booked on the Platforms, or any other obligation which has accrued, or is unfulfilled and relates to the period, prior to termination.

11. GENERAL CLASUES

Way2village does not control or operate any resorts, farmhouse, villas, hotel, transport vehicles, restaurant, kitchen caravan or any other facility and shall not be responsible for any delay, improper service, and standard of service provided by any affiliates/service providers, or for any injury, death, loss or damage which is caused by the act or default of any seller/service provider. Way2village being merely a facilitator, shall not be liable for the following:

  • 11.(a) Personal injury, sickness, accident, death, loss, delay, discomfort, increased expenses, incidental, consequential loss and/or damage or any kind of theft howsoever caused to the final Users;
  • 11.(b) Any act, omission, default of any affiliates or third party or any other person or by any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the guests or for any person traveling with him /her;
  • ​​​​​​​11.(c) The temporary or permanent loss of, or damage to, baggage or personal belongings howsoever caused including willful negligence on the part of any person;
  • ​​​​​​​11.(d) Any delay made in delivery of the service by the concerned service providers;
  • ​​​​​​​11.(e) Failure on part of resorts, farmhouse, villas, hotel to allow check-in despite confirmed booking for whatever reason;
  • ​​​​​​​11.(f) Any claims of any dispute with the tour manager/tours agents​​​​​​​

12. FORCE MAJEURE

Way2village will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond Way2village’s reasonable control.

13. WAIVER

No provision in these Terms will be deemed waived and no breach excused, unless such waiver or consent is in writing and signed by Way2village. Any consent by Way2village to, or waiver of a breach by the User, whether expressed or implied, will not constitute consent to, waiver of, or excuse for any other different or subsequent breach.

14. SEVERABILITY

If any provision of these Terms is held by a court of competent jurisdiction to be unenforceable under applicable law, then such provision will be excluded from these Terms and the remainder of these Terms will be interpreted as if such provision were so excluded and will be enforceable in accordance with its terms; provided however that, in such event, these Terms will be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable 16 | P a g e law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction.

15. ARBITRATION

Any disputes and differences whatsoever arising in connection with these Terms shall be settled by Arbitration in accordance with the Arbitration and Conciliation Act, 1996. All proceedings shall be conducted in English language. Unless the Parties agree on a sole arbitrator there shall be three Arbitrators, one to be selected by each of the parties, and the third to be selected by the two Arbitrators appointed by the parties. The venue of Arbitration shall be Chennai, India.

16. GRIEVANCE REDRESSAL

The User may submit any grievance with respect to the Platform or the Services, including with respect to any abuse on the Platform, including any discrepancies or grievances with respect to processing of information, to the Grievance Officer at:

17. GOVERNING LAW

These Terms, all transactions consummated between you and Way2village and the relationship between you and Way2village is governed by the laws of India, without reference to any conflict of laws principles and with an exclusive jurisdiction to the courts of Chennai in Tamilnadu State.

Instructions and guidelines for tourists who plan to stay at farmhouses

Booking Confirmation:

Ensure you have received a booking confirmation with all the necessary details, including check-in and check-out dates and times.

Contact Information:

Save the contact information of your host or the farmhouse owner. This will be useful for communication and in case you need assistance during your stay.

Arrival Information:

Confirm the address and directions to the farmhouse. Make sure you have a clear understanding of how to reach your destination.

Check-In Process:

Communicate your estimated arrival time to the host and follow their instructions for check-in. Be punctual to avoid any inconvenience.

House Rules:

Familiarize yourself with the house rules provided by the host. Respect any guidelines related to smoking, noise, pets, or other specific rules.

Safety Precautions:

Prioritize safety during your stay. Identify emergency exits, locate first-aid kits, and inquire about any safety concerns specific to the farmhouse.

Farm Tour:

If meals are included in your stay, confirm the meal schedule and any dietary preferences or restrictions you may have with the host.

Follow the host's instructions regarding waste disposal, recycling, and composting. Contribute to the eco-friendly practices of the farm.

Local Attractions:

Explore nearby attractions and activities recommended by the host. Take advantage of the opportunity to immerse yourself in the local culture and environment.

Communication:

Maintain open communication with the host throughout your stay. If you encounter any issues or have questions, don't hesitate to reach out for assistance

Check-Out Procedure:

Familiarize yourself with the check-out procedure. Ensure you leave the farmhouse in the same condition as when you arrived.

Feedback and Reviews:

Consider leaving feedback or reviews about your experience. Your input can help future travellers make informed decisions and assist the host in improving their services.

Respect for Hosts:
